The Site and Services are the wholly-owned, copyrighted property of BlueBench Technologies. ("Company"), and are subject to Indian copyright protection laws.

invitaZ digital invitations, a service of BlueBench Technologies is provided to you at a fee or recurring fee. We expect the services offered will change over time. In particular, we will make feature changes and/or add advanced or premium user services or add-ons that may only be available for additional one-time or recurring fees on an opt-in basis. Your right to use this service is limited in scope, revocable, personal, non-transferable and non-exclusive.

 

Breach of Terms & Conditions

If you violate any of these terms & conditions your account will be terminated. We may immediately deactivate your account and prevent access to all of your data without prior notice or liability to you.

 

Signup, Privacy, and Registration Data Rights

To access invitaZ digital invitations you will be required to register or sign up for an account and provide a password to secure the account. For payment, you must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process. BlueBench Technologies does not sell, trade, or otherwise transfer to outside parties your personal signup data or any other personally identifiable information or data, with the exception of when we believe the release is necessary to comply with the law. Credit Card Information

No one at BlueBench Technologies can see your credit card information. We use PayUmoney for payment processing. PayU encrypts your credit card information in their database and is PCI and GDPR compliant, so you can feel good about how they secure your information.

 

Security and Password

BlueBench Technologies encrypts your password in our database for security. It is your sole responsibility to maintain the confidentiality of your password and account. If you forget your password we will send a secure link to your email address so you can reset it.

 

Your Content and Code of Conduct

You are responsible for all content posted and activity that occurs under your account. This means that you need to ensure that all of the content posted using invitaZ digital invitations complies with all applicable laws and regulations, including (but not limited to) Indian copyright law. BlueBench Technologies does not pre-screen content to ensure compliance, but we do have the right (but not the obligation) to refuse or remove any content that is available via the invitaZ digital invitations service, at our sole discretion.

If you upload images to be used with the invitaZ digital invitations service, you must either own the image(s) or have the rights to use them for your intended purpose.

You may not impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity, or make available any material that contains software viruses, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware equipment or interfere with or disrupt the invitaZ digital invitations service.

You may not redistribute or post any graphic image from this site or service on any electronic bulletin board, put these images in a down-loadable or retrievable format, or resell these images.

 

Subscription Service

You will receive access to invitaZ digital invitations for free or on a monthly or yearly subscription fee basis. If you buy one of our subscription plans or add-on subscription, the renewal term is either monthly or yearly, depending on your plan choice. Your account will not renew automatically. We reserve the right to raise or lower the price of our services from time to time. 

 

Effect of Payment Failure

If you cancel your account, then you will no longer have access to the features and privileges of invitaZ digital invitations. Any web links you have established for QR codes, Online digital invitations will be deactivated. File storage is not guaranteed for cancelled accounts. Designs and data may be subject to removal and deletion. If your form of payment fails after several renewal attempts, your account will move to cancelled status. Reactivating a cancelled account requires payment at the most current rates.

 

Currency Conversion

You will be charged in Indian currency, either monthly or yearly, both in INR (₹). Any other currency rates that may be displayed are for information purposes only and are subject to change without notice. BlueBench Technologies cannot guarantee the accuracy of other currency rates displayed.

 

Requirement to Be in Good Standing

Usage Rights are granted to individual customers that have an active (not cancelled) account with a valid username and password at www.invitaz.com. 

BlueBench Technologies may revoke privileges to anyone it believes is abusing the Site, as well as seek legal remedies necessary to protect its copyrights and intellectual property. BlueBench Technologies also reserves the right, at its sole discretion, to refuse or cancel service to anyone it deems to be creating offensive material.

 

Free Accounts

Free accounts give you limited access to invitaZ digital invitations software service, as outlined on the then-current subscription plans. We may update or change features that are accessible via our free plans at any time. If you sign up for a paid subscription and cancel in the future, it is necessary to sign back up with a valid credit or debit card for access to your account. We do not offer a free account option once you have purchased our paid plans.

 

Free Demo

Access to an invitaZ digital invitations demo, that you may freely use without signing up for the invitaZ digital invitations service, may be available from this website at no charge.

 

Software and File Compatibility

We are constantly updating our software service platform. Our software versions and file formats become obsolete and unusable over time as we strive to keep up with advances in hosting services, operating systems and browsers. We strive to minimise adverse effects on customers, offering extended periods of notifications, support, instructions, and pathways for updating. Obsolete or unusable files may be archived, removed and/or permanently deleted from your Account at any time.

 

Downgrade and Termination

An email or phone request to cancel your subscription is not considered cancellation. If your payment method is declined over several days of repeated attempts, or if you have not paid the subscription fees, your subscription will be automatically cancelled.

Once your subscription is cancelled you will lose access rights to that account. Your personal signup data will be retained with the intent of enabling you to reinstate your subscription to access your prior menu content, if it still exists, at a later date. If you wish to forgo this option and want to have your personal data permanently removed from our database, you should notify us at our company contact page and request that we do so.

If you downgrade your subscription plan before the end of your current paid up billing period (month or year), you are charged for the current billing period (month or year), but you will not be charged again.

If you reinstate your subscription by re-subscribing with the same personal signup information (email address and password), your prior menu content data will be accessible, unless it was removed due to violations of these terms & conditions.

BlueBench Technologies may, at our sole discretion, terminate or suspend your access to all or part of invitaZ digital invitations without prior notice or liability to you.

 

Pricing & Refunds

We want you to be happy with invitaZ digital invitations service. If something's not right for you, email us and we'll try to make it right. Since we offer a free plan, BlueBench Technologies does not offer refunds for the invitaZ digital invitations service, including refunds for partially used terms.

We reserve the right to raise or lower our prices or to offer special discounts. If your Account is affected by a price change, you will be notified in email or on the site. We have no way of guaranteeing that you will receive our notifications in a timely manner. All prices are in Indian Rupee i.e. INR (₹).

 

Content Submissions from Accounts

By uploading or entering content, including menu copy, designs, names, prices, logos, marketing graphics, food photos, ideas, concepts, or any other type of content (collectively "Your Content"), in the ordinary course of using the invitaZ digital invitations Services, you hereby grant and, where applicable, warrant that the owner of such content or intellectual property has expressly granted BlueBench Technologies and its customers and partners a non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable and transferable, worldwide licence to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and publicly display Your Content in any manner. The intent of this grant is to enable BlueBench Technologies to successfully deliver our full range of services, as well as for promotional purposes.

By uploading Your Content to invitaZ digital invitations Service, you warrant that you have all necessary licences and permissions to use and share Your Content and the rights necessary to grant the licences in these terms & conditions.

You will indemnify us from any claim, demand, loss, or damages, including reasonable attorney's fees, arising out of or related to Your Content, your use of the Services or your violation of these terms & conditions.

 

Rights and Access Privileges Do Not Transfer

invitaZ digital invitations service accounts may not be transferred, shared, traded or sold.

 

Additional Users

Each Account may only be used by one Account holder or single individual. A single account login shared by multiple users is strictly prohibited. Businesses or groups must create separate accounts with unique logins for each user or contact customer service to discuss licence options.

 

Content licence

All accounts may use the Services to create business Content in the form of menus, flyers and other promotional materials, and are hereby granted a non-exclusive, royalty-free licence to use the Content for any business, personal or charitable purpose. Stock images and graphics available on invitaZ digital invitations may only be used in combination with templates, and not copied or used in original form.

 

Limitation of Warranty and Liability

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don't promise about our Services.

invitaZ digital invitations service is provided by BlueBench Technologies on an "as is" and "as available" basis. We do not guarantee and are not liable for any failure to access or store your data on invitaZ digital invitations at any time. Like all cloud-based applications, we are vulnerable to the inherent unreliability of the Internet.

IN NO EVENT WILL “BLUEBENCH TECHNOLOGIES”, BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, ECONOMIC, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE “INVITAZ DIGITAL INVITATIONS” WEBSITE OR SERVICES, EVEN IF “BLUEBENCH TECHNOLOGIES” HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability in any matter arising out of or related to these terms & conditions is limited ₹99/- or to the aggregate amount that you paid for access to the Service i.e. subscription charged during the month of the event giving rise to the liability, whichever is larger. This limitation will apply even if we have been advised of the possibility of the liability exceeding the amount and notwithstanding any failure of essential purpose of any limited remedy. The limitations and exclusions of this Section apply to the maximum extent permitted by law.

 

Without limiting the foregoing, we make no warranty that:

• The service will meet your specific requirements.

• The service will be uninterrupted, timely, secure, error-free, or data-loss free.

• The results that may be obtained from the use of the service will be effective, accurate, or reliable.

• The quality of the service or materials purchased by you will meet your expectations or be free from mistakes, errors, or defects.

• The invitation cards created with invitaZ digital invitations will be 100% screen readable or fully compliant with any other accessibility compliance format.

• Any errors or defects in the service will be corrected.

invitaZ digital invitations service could include technical or other mistakes, inaccuracies, or typographical errors. We may make changes to the materials and services, at any time without notice. The invitaZ digital invitations service and BlueBench Technologies materials may be out of date, and we make no commitment to update such materials or services.

If there is a conflict between these terms & conditions and the additional terms & conditions, the additional terms & conditions will control for that conflict.

Term

This Agreement shall commence on the date you first use the invitaZ digital invitations service. Notwithstanding the foregoing, BlueBench Technologies may stop, temporarily or permanently, providing the invitaZ digital invitations service or any features within invitaZ digital invitations, to you or users generally and may not be able to provide you with prior notice. We retain the right to create limits on access and expiry of our service at our sole discretion at any time without prior notice.

 

Children and Minors

The invitaZ digital invitations service is not intended for use by minors under the age of 18. We do not knowingly solicit any information from such minors. If you are a parent or legal guardian who discovers that your child has provided us with information without your consent, you may notify us at our company contact page and request that we permanently remove such information from our database.

 

Governing Law and Jurisdiction

The invitaZ digital invitations service is controlled by BlueBench Technologies located in Udupi district of Karnataka State in India. It can be accessed from all the countries around the world. As each of these countries have laws that may differ from those of India, by accessing invitaZ digital invitations you agree that all matters related to the use of invitaZ digital invitations shall be governed by the laws of India, without regard to the conflicts of laws principles thereof.

You also agree and hereby submit to the exclusive personal jurisdiction and venue court of jurisdiction in Udupi within the State of Karnataka with respect to such matters.
